1. Intermediary Status
Zappwala operates solely as an intermediary platform under Section 2(w) of the Information Technology Act, 2000. We provide a digital marketplace connecting users with independent vendors, service providers, event organizers, rental providers, and merchants.
We do not:
- Own the products listed by vendors
- Directly provide third-party services unless expressly stated
- Control the execution of services provided by vendors
- Guarantee quality, legality, or suitability of listed services/products
2. No Warranty Disclaimer
All services and listings are provided on an “AS IS” and “AS AVAILABLE” basis.
Zappwala makes no warranties regarding:
- Accuracy of listings
- Availability of vendors
- Service quality or performance
- Fitness for a particular purpose
- Uninterrupted or error-free platform access
3. Vendor Responsibility
All vendors are independent entities. Vendors are solely responsible for:
- Service delivery
- Product authenticity
- Licenses and regulatory compliance
- Pricing accuracy
- Tax compliance (GST or applicable taxes)
- Refunds (where applicable)
Zappwala is not liable for disputes between users and vendors.
4. Booking & Payment Disclaimer
Zappwala facilitates digital booking and payment processing through third-party payment gateways. We do not store complete financial details such as debit/credit card numbers.
Payment failures, gateway delays, or banking errors are beyond our direct control.
5. Limitation of Liability
To the maximum extent permitted under applicable law, Zappwala shall not be liable for:
- Indirect or consequential damages
- Loss of profits or business interruption
- Personal injury caused by vendor services
- Property damage arising from vendor transactions
- Unauthorized access due to user negligence
Total liability, if any, shall not exceed the platform fee or commission earned by Zappwala from the specific transaction.
6. Third-Party Links
The Platform may contain links to third-party websites or applications. Zappwala is not responsible for the content, policies, or practices of third-party services.
7. User Responsibility
Users agree that they:
- Provide accurate information
- Use the platform lawfully
- Verify vendor credentials before booking
- Exercise due diligence before making payments
8. Regulatory & Legal Compliance
Zappwala complies with:
- Information Technology Act, 2000
- IT Rules, 2021 (Intermediary Guidelines)
- Digital Personal Data Protection Act, 2023
We reserve the right to remove content or suspend accounts that violate applicable Indian laws.
9. Force Majeure
Zappwala shall not be liable for failure or delay in performance due to events beyond reasonable control including natural disasters, government actions, internet disruptions, strikes, or technical failures.
10. Jurisdiction
This Disclaimer shall be governed by the laws of India. Courts located in Guwahati, Assam shall have exclusive jurisdiction over disputes.
